1.1 Get2sms FREE SMS Services. Get2sms offers free SMS services to its Users to enable them send FREE personal messages to persons who they are acquainted to. Thus a communication between two persons who know each other is required. The get2sms service, product and/or service may not be used to solicit payment or for sales of good and service, or increase traffic to your business for commercial reasons, such as advertising, sales or marketing.
1.2 Get2sms Website: The website www.get2sms.com offers its services and products or products/services as provided by SMS Territory Nigeria Limited. Get2sms, the get2sms logo, trademarks and any other symbols of ‘get2sms’ products and services referred to on this get2sms website are trade marks of get2sms or its holding companies..
1.3 Provisional Act: The website www.get2sms.com is governed by and provided in accordance to the National Information Technology Development Agency Act, 2007 NITDA (Government of Nigeria), Nigerian National Policy for Information Technology IT and the common law of contract, these Terms of use are valid, binding and enforceable for all persons or users that access the get2sms.com website, the web pages or any part thereof. Hence, if you do not agree to be bound over by these Terms of use, then you may not use the get2sms website. The reasonable use of the get2sms website shall automatically bind the Users to this agreement.
1.4 User Identity and Authentication: Users authorize get2sms to use his/her mobile number to validate his/her identity. During the registration process, get2sms requires that User provide his/her applicable mobile number, which is used to uniquely identify the User while using get2sms products and/or services. By registering on get2sms website, User
explicitly agrees to update get2sms whenever there is a change in the status of his/her mobile number.
1.5 Contextual Advertisement: It is important to note that get2sms service is provided as an ad-funded service. This means that delivering contextual advertisements and related links within User SMS message underpins the provision of this FREE service. If user SMS is less than 80 characters, get2sms reserves the right to append SMS filling up the remaining of the User SMS..
1.6 Your Privacy: Protecting your privacy is very important to get2sms. Please review our Privacy Policy in order to better understand our commitment to maintaining your privacy, our use and disclosure of your Information and our anti-spam policy.
1.6 Account Termination: The user has the right to terminate his/her account at any given time by emailing accounts at get2sms.com indicating the choice to close the account.
2. Eligibility
2.1 Eligibility: To be eligible for our Services, you must be resident in Nigeria, have a functional mobile phone connection subscribed to any of the Mobile Network carriers in Nigeria.Thus this terms of use applies to only users who are resident in Nigeria.
3. Product and Services
3.1 Product and Services: The product and services include, FREE person to person SMS/text messaging upto 90 characters.
A standard SMS can be up to 160 characters. Users send free SMS up to 90 characters in length. Advertisers append a contextual advertisement to this SMS making up the rest of the 160 characters. Users get this free SMS text messaging service in exchange for opting in to have targeted ads appended to their messages. As a User, you opt in to carry advertisements in your personal SMS and in exchange you get to send SMS free.
User shall be required to create an account in get2sms website to be able to enjoy this FREE Products and/or Services. A one-time completion of the get2sms registration form is the requirement to create an account. Users are responsible to ensure that information provided in the registration form is accurate as inaccurate data may result in the suspension and ultimately barring of the account.
During the registration process, the User will be required to choose a unique “username” required during login. Upon completion of the registration form, get2sms shall send out a "password" to the User provided mobile number. Using the chosen Username and the get2sms-sent password, the User can log in to the get2sms.com account as required.
4. Your Obligations - Actions We May Take
4.1Your Obligations
4.1.1 Your Account: You shall be responsible for accuracy of the information provided in your account profile page during or after you have registered in get2sms.com. Also, you shall be responsible for preserving the confidentiality of your account (”Account”) as well as its usage. After an account is created and is in existence, barring may result if the account remains inactive for a period of 25 consecutive days.
4.1.2 No spanning permitted: Your get2sms account, may not to be used for the distribution of any of these kinds of messages; spam, unsolicited, advertisement, sales, marketing, commercial, abusive, obscene, insulting etc, that will undermine applicable local, national and international laws and regulations or infringe on any individuals right. You may not attempt to gain unauthorized access to any services, devices, User accounts, computers systems or network, through hacking, password mining or any other means.
4.1.3 4.1.9 Beware: You may not use this service as an avenue to collect information like email addresses about other users without their consent. Therefore, any user suspected to engage in the use of the services offered by get2sms to collect information from other users or solicit information from unsuspected persons in relation to any form of advanced fee fraud popularly called ‘419’ should note that get2sms, as responsible corporate citizen, is bound to ensure that such persons, Users, will be reported to the responsible authorities.
4.2 Actions by get2sms. If we have reason to believe that you have engaged in any form activities have been implicitly identified in this terms and agreement or have cause to receive complaints from recipients or other parties with respect to your activities in the use of get2sms services, we may take action by limiting your account temporarily, such as limiting access too your ability to send Free SMS from your account, suspending or barring your account as the case may be. In addition, we may resolve to disclose any and all information to the recipient, applicable authorities or any other related party with regards to the User in question. User are adviced to use this service wisely.
Get2sms, in its sole discretion, reserves the right to terminate this Agreement, access to its website, or access to the Service for continuous violation of the terms of use stipulated in this document. In such an instance, user remains responsible for any obligation that have been accrued including the payment of any costs, charges, or any legal obligations that may arise in connection to such termination, cancellation or suspension.
5. Warranties
Get2sms website is provided “as is” and “as available”. Get2sms makes no warranties about the accuracy, reliability, completeness or timeliness of the materials included in get2sms website. Get2sms shall not be liable to any party for any compensatory, direct, indirect, special, consequential, punitive or other damages or losses caused by materials included in Get2sms website or modification of the materials, or for damages caused by the use of Get2sms website or inability to use or access the website.
In our commitment to ensure that we provide users with this service and experience, we must state that get2sms cannot guarantee the availability of this product or services at all times and in all locations. The User expressly acknowledges and agrees that the use of the Products and/or Services is generally at its own risk.
Also our website may be unavailable due to unforeseen circumstances including updates, virus attacks and other forms of natural disasters beyond the control of get2sms.
Though get2sms shall take all reasonable caution about the quality and accuracy of content available from the get2sms website, get2sms does not make any warranties or representation that the content available shall in all cases be true, correct or free from any errors.

e. “Contextual Ad" means appended based on users context
